Package note: analyzes Presidential Determination No. 2026-24 of Sept. 25, 2026, “Presidential Determination on Refugee Admissions for Fiscal Year 2027,” published at 91 FR 63119 (Oct. 2, 2026). A determination sets a ceiling under INA §207. It does not admit anyone, fund resettlement, or lift the separate refugee-entry suspension. The President has set the FY2027 refugee ceiling at “up to 17,500,” the same level he reached mid-year in FY2026 through an emergency determination. The slots go “primarily” to Afrikaners from South Africa, and every admission stays subject to the refugee-entry suspension already in force.

Core Tension

The determination says admitting up to 17,500 refugees is “justified by humanitarian concerns,” yet it directs those slots “primarily” to one group from one country and keeps the general refugee suspension (EO 14163) in force for everyone else. It is also a ceiling that “may reach but not exceed” 17,500, with no floor. FY2026 shows what that means in practice: nearly 3,000 admissions through August under a FY2026 ceiling that was 7,500 until an emergency determination raised it to 17,500 on May 21, almost all of them South African. The headline number is a ceiling. The executive orders stacked on top decide who actually arrives.
